What are the defenders of Dubkov fighting for?

Park defenders draw attention to massive violations during the development of the territory by the developer, LLC “Residential Complex “On Ivanovskaya” (hereinafter - “LC “On Ivanovskaya”): an illegally issued urban planning plan for a land plot (GPZU), a building permit, as well as illegal felling of trees without cutting tickets.

Land for kindergarten

We figured out what happened to the plot of land on Ivanovskaya Street.

In 2002, the Moscow Land Committee gave this site under Kindergarten for 25 years. And in 2011, the Department of Land Resources concluded an additional agreement to the lease agreement: under this agreement, from September 30, 2010, the rights and obligations under the agreement were transferred to the ZhK Na Ivanovskaya. The contract established that the land plot was provided to the developer without the right to change its functional purpose (functioning of a children's institution).

In other words, when the Residential Complex “On Ivanovskaya” received a plot, nothing but nurseries and kindergartens could be built on it. This met the needs of residents: even the mayor of Moscow Sergei Sobyanin said that there were not enough places in kindergartens in the city, and new ones needed to be built.

Blitzkrieg "Centrograd"


However, construction work is currently underway on the site. “LCD “On Ivanovskaya” is building not a kindergarten or a nursery, but a whole multi-apartment residential complex. How did the developer get the opportunity to build it almost on the territory of the Dubki park, having cut down a large number of trees?

Let's tell everything in order. On June 4, 2015, the founders of the Residential Complex Na Ivanovskaya include the offshore Nordnet Holdings Limited, Centrograd LLC and Lyubov Yuryevna Tsvetkova. Just 11 days after that, on June 15, 2015, “LC “On Ivanovskaya” applied to the Government of Moscow with a statement about changing the purpose of providing a plot of land on Ivanovskaya. And already on September 9, 2015, the Department of City Property of the City of Moscow issued an order (pdf), according to which the purpose of providing a land plot changed from “provided for implementation educational activities” to “design and construction (reconstruction) of capital construction projects”. Thus, the department allowed the construction of a residential complex on the site of the kindergarten just two months after Centrograd LLC, the offshore company and Ms. Tsvetkova became the founders of the developer.

Just a month later, on October 8, 2015, by order (pfd) of the Moscow Department of City Property, ZhK Na Ivanovskaya was granted an installment plan of more than 420 million rubles for three years. Almost immediately after that, LLC "Centrograd" withdrew from the founders of the residential complex "On Ivanovskaya".

So, we found out that from June to November 2015, while Tsentrograd LLC was a co-founder of ZhK Na Ivanovskaya, a structural unit of the Moscow Government for some reason changed the intended purpose of the land plot, and also provided the developer with an installment plan for paying rent fees. It must be said that changing the purpose of a land plot from “conducting educational activities” to “designing and constructing (reconstructing) capital construction facilities” is a procedure close to impossible: the developer needs to convince the mayor’s office that instead of a socially significant kindergarten, it is necessary to build residential quarter. And the mayor's office, given the lack of kindergartens in Moscow, must agree with this incident.

To understand how the Residential Complex "On Ivanovskaya" succeeded, we figured out the decision-making mechanism of the Moscow Government in the field of land use.

Supercommission

In 2010, the Town Planning and Land Commission (GZK) was established in the capital. Formally, the SLC is only an advisory body, but in fact it has very broad powers. On a weekly basis, the SLC distributes binding instructions to the Moscow executive authorities.

It is on the basis of the decisions of the SLC that all further land and town planning documents are approved. Without it, you cannot get a building permit or an order to change the purpose of providing the site. The commission does not publish its protocols, does not publicly report on the work done, with the exception of scanty news notes on the website of the Moscow government. Formally, the GZK is headed by Mayor Sobyanin, but the actual preparation and decision-making is supervised by the vice-mayor for construction. Marat Shakirzyanovich Khusnullin. [...]

We were surprised by the incredible speed of the commission's work: on September 18, 2014, the SLC met for a regular meeting, where it managed to consider 61 working issues in one hour. Among these issues was the decision to change the purpose of the land plot on Ivanovskaya Street, which we already know.


It seems doubtful that the Chairman of the State Legislative Committee delved deeply into the essence of the issues discussed at the meeting. According to the information we have, it was Mr. Khusnullin and his subordinate, the chairman of the Committee for Architecture and Urban Planning, Yuliana Vladimirovna Knyazhevskaya, who presented the investment project “ZhK on Ivanovskaya” at the meeting of the SLC.

From the presented presentation it can be seen that the developer already has plans for the neighboring site, where the Treasure Island kindergarten is still functioning.

Over the next year, ZhK Na Ivanovskaya was preparing the rest of the necessary documentation: it received an urban planning plan for a land plot, concluded a loan agreement with a bank, and approved the architectural and urban planning solution for a capital construction project.

Local residents were extremely concerned about the possible cutting of trees and the construction of a residential area in the green zone and began to send requests to the authorities.

The head of the Moscow Department of Construction responded to a request from a municipal deputy that the construction of a residential complex is taking place as part of the implementation of an investment contract. There is a confirmation of this on the website of the United Bank of Projects of the City of Moscow.

"Kindergartens are rarely requested"

A single bank of projects was created by the Association of Investors of the city of Moscow, which is headed by Lyubov Yuryevna Tsvetkova, already known to us. The Investors Association actively cooperates with the Kazan team of the Moscow Government: they hold joint seminars and organize working groups for developers and investors. Under the auspices of Moskomstoinvest and with the personal approval of Vice Mayor Khusnullin, the Investors Association created the previously mentioned United Bank of Moscow Projects.

As we already wrote, Mrs. Tsvetkova was one of the owners of the “LCD “On Ivanovskaya”. She also owns LLC "Company-2000" - the technical customer of the project "Residential Complex "On Ivanovskaya". Lyubov Yuryevna has been the owner of the developer since 2009, and in May 2015 she increased her stake in the company to 10%.

On June 30, 2015, a development project near Dubki Park was posted on the website of the Project Bank, indicating the type of permitted use as “residential development”.

The project bears the symbolic stamp “documentation checked by Moskomstroyinvest”, although in reality the order to change the purpose of providing a site for construction will be received only after two months. It can be argued that in June 2015, Lyubov Yuryevna was absolutely sure of the necessary change in the purpose of providing the land plot. At the same time, she had a direct interest in its implementation, since she was one of the owners of the developer company.

Talented Mr. Shemmedov

Until November 2015, Tsentrograd LLC was the second founder of the LCD on Ivanovskaya. Until June 1, 2016, Maksat Shemmedov was listed as its sole owner. Mr. Shemmedov is quite young and has recently graduated from a higher educational institution. We have not been able to find significant income and large companies, which he could be the owner of.

From June to November 2015, Centrograd LLC is a 15% share of the authorized capital of ZhK Na Ivanovskaya.


During these few months, key events for the developer took place: he managed to change the purpose of the land plot and obtain an additional agreement to the land lease agreement. Also, the developer received a deferral of payment of 400 million rubles under the lease agreement for a three-year period.

Since the change of its designated purpose, the cadastral value of the land has tripled - from 145 to 517 million rubles.


Thus, at the time of the sale of Tsentrograd LLC of its share in the authorized capital of ZhK Na Ivanovskaya, 15% of Maksat Shemmedov cost approximately 77 million rubles. The actual amount of the transaction could be much more.


On a specialized website for investors-developers, it is indicated that the price of the transaction for the sale of the residential complex "On Ivanovskaya" after obtaining permits for the project exceeds 1 billion 600 million rubles. In this case, the income of a 23-year-old entrepreneur could reach 240 million rubles.

How did a recent student manage to become the founder of a one and a half billion dollar development project in the green zone of Moscow?


We assume that Mr. Shemmedov was only a nominal owner of ZhK Na Ivanovskaya LLC through Centrograd LLC, and the real owners did not want their names to appear in this project. Paying tribute to the entrepreneurial success of Maksat Shemmedov, we paid attention to his relatives.

Kristina Orazovna's wife's name is Ildus Minnikhanov. In 2011, he received the status of an adviser to the Deputy Mayor of Moscow in the Government of Moscow, Marat Shakirzyanovich Khusnullin, who is responsible for Moscow's urban planning policy and construction.

Marat Khusnullin made a career as an official in Tatarstan: from 2001 to 2010 he was the Minister of Construction, Architecture and Housing and Communal Services of the Republic. At the end of 2010, Khusnullin was appointed Deputy Mayor of Moscow in the Moscow Government for urban planning policy and construction, and since 2013 he became Sobyanin's deputy for urban planning policy and construction.

In accordance with paragraph 1 of Art. 10, pp. 1-2 tbsp. 11 and Art. 13.1. federal law No. 273-FZ of December 25, 2008 “On Combating Corruption”, a conflict of interest is understood to be a situation in which the personal interest (direct or indirect) of a person holding a public position of a subject Russian Federation affects or may affect the proper, objective and impartial performance of his duties. This person is obliged to notify of a conflict of interest or the possibility of its occurrence and to take measures to prevent any possibility of a conflict of interest as soon as it becomes aware of it. Given the above, in this situation one can see an undeclared conflict of interest by the Deputy Mayor of Moscow in the Government of Moscow, which is a violation of Federal Law No. 273-FZ of December 25, 2008 “On Combating Corruption”. If this information is confirmed, Marat Shakirzyanovich Khusnullin, Deputy Mayor of Moscow in the Moscow Government for urban planning policy and construction, should be dismissed from his post due to loss of confidence.
