According to the Law of February 12, 1993 N 4468-1, a seniority pension is awarded to servicemen after 20 years of service in the Armed Forces, as well as in various units of the Russian law enforcement agencies. According to the current legislation, a seniority pension can be assigned to military personnel who are serving in the military and retire to the reserve after 20 years in a military position. Dismissal is a prerequisite: you cannot serve and receive a military pension at the same time. If a military pensioner decides to return to service after his dismissal, the payment of the pension is terminated, and he receives monetary allowance from the Ministry of Defense until the moment of re-dismissal and appeal to the pension authority.

Not always a military pension is a seniority pension. It can be assigned for several other reasons:

  • Obtaining a disability during the period of service. Disability or serious disease must be documented.
  • Calculation of a pension for the widow of a serviceman for the loss of a breadwinner. It is accrued if the widow was unable to earn her own insurance experience while living in closed military camps or in remote regions of the country.

So far, the length of service for military personnel for retirement is 20 years, although there are active talks about increasing this period to 25 years. It is planned to carry out a reform for employees of law enforcement agencies, for whom the retirement age will be increased, and the payment will be indexed by a fairly large amount.

Prospects for pension reform

The bill is still under consideration and discussion, although it was originally expected to enter into force as early as 2018. The state seeks to find financial reserves and save money, and for this it is planned to increase the retirement age in all spheres of life, including in the army.

If the law goes into effect, the increase in the length of service for pension eligibility from 20 to 25 years for the military will lead to a sharp reduction in the number of military pensioners, as well as an increase in the length of service. At the same time, the age limit for military personnel is 45 years, although this bar may also be increased in the future.

Since the state seeks to reduce costs in all areas, the optimization will also affect departmental medical institutions. It is planned to transfer the medical institutions of the Ministry of Internal Affairs and military hospitals to the Ministry of Health, so that medical assistance to the military and representatives of law enforcement agencies is provided on a common basis. It turned out to be agreed by the departments that provide for the passage of military service, a bill providing for an increase from 20 to 25 years of service required for appointment military pension. At the same time, it differs significantly from the bill that we wrote about in our June 15, 2017 and which was prepared by our military lawyers. Most importantly, it is assumed that this bill will be submitted to the State Duma this autumn and should come into force on January 1, 2018, and not on January 1, 2019, as previously proposed. However, the bill itself provides for a transitional period until January 1, 2023, during which military personnel with 20 years of service or more will be able to retire from military service with the right to receive a military pension under the same conditions. In addition, it is assumed that in the event of the dismissal of a serviceman on one of the so-called "preferential" grounds (reaching the age limit for military service, health status, organizational and staffing measures, as well as dismissal from military service due to non-fulfillment of the terms of the contract by Ministry of Defense of the Russian Federation (another federal executive body in which the law provides for military service) if he has served for 20 years or more, a pension will be assigned under the same conditions that are currently in force.The new bill provides that minimum size pensions for 25 years of service will be 65% of the corresponding amounts of monetary allowance taken into account for the appointment of a military pension (salary according to military rank, salary according to position (official salary) and percentage bonus for length of service), and the maximum - 95% of the specified amounts of monetary allowance. In this draft law, in contrast to what was promulgated earlier, there is no rule providing for an increase in the amount of the above allowance for length of service paid to military personnel and which is taken into account when assigning a military pension, it is not reported, apparently due to lack of money in the budget, to do this no longer planned. Some media reported that such a maneuver would give a respite to the federal budget, as it would allow several billion rubles to be released for some time, which is very important in the difficult economic conditions in which our state finds itself.

At the same time, Kommersant reports that, according to information from his source close to the presidential administration, "a fundamental decision to raise the lower limit of seniority for military personnel has been made." Thus, it can be assumed with a high degree of probability that the minimum length of service required for the appointment of a military pension will still be increased in the near foreseeable future from 20 to 25 years.

In the summer of 2017, almost to the same day as today, the Russian media reported on the upcoming reform of military pensions. News about the preparation of an increase in length of service up to 25 years for military personnel

The existence of a bill to increase the minimum length of service for the military from 20 to 25 years was reported a year ago by the publication Kommersant. Referring to its sources in the Ministry of Defense and other security agencies, the newspaper wrote that in March 2017, the Russian President instructed to prepare a draft law on increasing the length of service for security officials. At the end of May last year, the project was ready.

The idea of ​​raising the minimum length of service required to receive a military pension did not arise out of nowhere. By the time the president instructed to work on this issue, the retirement age for Russian civil servants had already been increased. For the same military pensioners who are already retired, they froze the reduction coefficient that links pensions to salaries in the army and which was supposed to increase annually until the pension of a retired military would coincide with the salary of an employee in the same rank and at the same positions in active troops.

Saving the budget is one of the main tasks that the state had to solve after the start of the economic crisis in 2013-2014.

The mechanism for increasing the length of service for military personnel up to 25 years

The exact mechanism has not been revealed. Only one thing was known - for those military men whose current contracts are ending at the moment when their length of service reaches 20 years, the right to retire will come according to the old rules. Raising the minimum length of service will not affect them.

As for everyone else, it is not known for certain whether the bill provides for a transitional period or, if the bill is introduced and passed, it will enter into force immediately, and the military will simply be presented with a fait accompli.

Back in 2013, a similar draft law on increasing seniority appeared in the Ministry of Defense. In that bill, the mechanism was as follows - it was proposed to introduce a transitional period until 2019, during which military personnel could choose whether to retire after 20 years of service or continue their service, receiving an additional 25 percent of their salary possible pension. From 2019, according to this project, the length of service was to be increased to 25 years, and the transition period was to be completed.

The project for reforming military pensions from 2013, after the calculations were made, was recognized as not entirely successful - there were simply no funds for its implementation even at that time.

Two years later, in 2015, the Ministry of Finance came up with a rather radical proposal. The Ministry of Finance proposed to increase the minimum length of service for the military immediately to 30 years. The proposal, of course, did not find understanding and was not developed.

The history of the emergence of such projects suggests that they arise every two years and are safely forgotten. The ideas that were discussed in 2013 and 2015 were found to be inappropriate. The news about another bill that appeared in 2017 did not receive development either.

However, the 2017 project differs from the previous two in an essential detail - it was initiated by direct order of the president.

At the same time, in the summer of last year, Kommersant's sources made no secret of the fact that although the bill had been prepared in general terms, its adoption would certainly be delayed. In March 2018, presidential elections were held, and all decisions that were unpopular with the people were pushed into the background, and, if possible, they were simply not talked about.

Elections have passed, and the first unpopular measure, which is no longer embarrassed to talk about, is already being prepared for adoption. Talking about a raise retirement age for all Russians. The decision itself has not yet been made, but the government does not hide the fact that it will appear soon.

The same may well be expected of military personnel. Having carried out a reform with an increase in the retirement age for “civilian” pensioners, the state may well return to the topic of increasing the length of service to 25 for the military and other security officials. It is planned to adjust the conditions under which retirement is possible, as well as to increase the retirement age for receiving an insurance pension upon reaching a certain age.

At the same time, the possibility of making changes to the conditions for calculating pensions for security forces remains questionable. The government does not comment on future amendments. But it is likely that they will be introduced soon.

Representatives of the State Duma report that the length of service for the military and security officials will be increased, but a little later, so as not to create confusion among citizens.

In view of this, it is still unknown how and in what way military pensions will be adjusted, whether the length of service will increase, and most importantly, by how much. Also, no official documents were submitted for publication. But the authorities do not deny that changes in pensions for the security forces will still be carried out, it is only a matter of time.

A soldier who has more than 25 years of service will be offered to pay an allowance of 25% of the pension that he would be able to receive if he retired from military service. For each year, the amount of the allowance increases by exactly 3%.. But retirement will mean a complete recalculation of the final amount of earnings.

At the same time, citizens retain the right to receive a military pension after 20 years of service. However, it is possible only in a number of individual cases.

Unfortunately, at the moment there is no publication of the text of the bill for review in the public domain. It is possible to read the main postulates of the law and its theses only through the analysis of the media in unofficial sources. Specificity of the new draft law on raising the retirement age

What will be remarkable about this bill?

To date, it has been established that if a serviceman has a service of 20 years, then he is already assigned a pension, which is equal to 50% of the available monetary allowance.

Every year from the moment of reaching 20 years of service, the annual increase will be 3% to the already existing amount of 50% allowance. But the total amount of the allowance cannot exceed 85% of the initial salary of a soldier.

The bill proposes to reconsider this approach. Pension provision will begin to accrue at the moment when the length of service reaches the mark of 25 years. Not 50%, but 65% will be credited immediately. Each year, 3% of the pension will be accrued, and the maximum amount should not exceed 95% of the salary of a soldier.

The bill offers several options for dismissals from the armed forces on one of the preferential grounds:

  1. Reaching the legal age beyond which it is not possible to serve in the armed forces.
  2. In connection with the organizational and staffing activities and the subsequent reduction.
  3. An illness or serious health condition that does not provide for being in the ranks of the armed forces and is confirmed by a medical commission.

In such a situation, in accordance with the draft law, the appointment of a long-term pension will be provided, the amount of which will be equal to 50% of the funds received, provided that the serviceman has at least 20 years of service.

Every year he will be increased by 3%, but the amount of allowance received cannot exceed 95%.

The specificity of the law lies in the fact that it was adopted in order to eliminate the unfairly established high retirement age for ordinary citizens of the country who are not involved in military service. That is why the military was also extended the term to 25 years.

The bill itself was developed by the Main Directorate of Personnel of the Armed Forces.

More recently, it became known that this regulatory legal act has already been signed by the President of the Russian Federation and should come into force in 2019.

Adoption of a law on increasing the length of service for military personnel

To date, there is no indication in official sources when the law will be passed, and when the mention of the new length of service will come into effect. A process has not been defined that will include a transitional phase that should last until 2023.

Citizens who will be subject to the new legal act can retire even if they have 20 years of service, but subject to special conditions that will be valid until 2023.

Many media outlets claim that the approval of the project was completed in positive side. The decision on the issue of increasing the length of service has already been made, and the entry into force of the legislative act is only a matter of time.

The adoption of the project was scheduled for September 2018. But due to the difficult issues of pension reform for civilians, the bill for the military was shelved.

The principle of calculating military pensions

The calculation principle is very simple. It is necessary to take the general value of the EDV, which, in addition to the official salary, also includes all the allowances. Using this value and the characteristic pension coefficient, you can find out the approximate amount of the pension, which then must be compared with a reduction coefficient.

When calculating the pension, the following indicators are taken into account:

  • Salary for the awarded title.
  • Salary from the corresponding position.
  • Surcharges, in the amount of not more than 40% of the EDDV.

The formula looks like this.

EDDV * (50% +% for service) * reduction factor = pension amount.

It is still vaguely clear how the military pension will be calculated from 2019. After all, not all provisions of the new bill will be adopted immediately, which means that the calculation system should also change somewhat.

It is planned that at first, military personnel will be able to calculate an approximate pension using special online calculators. Later, there will be a generally accepted formula.

Cancellation of the reduction factor for military pensioners

The law promises to consider requirements for the abolition of the reduction factor. More than once the issue of introducing a reduction factor was checked for legality in the Constitutional Court. However, no violations of the constitutional rights of servicemen were found.

To date, the value of the reduction coefficient is 72.23% of the monetary allowance.

The ratio has not changed since 2017. After the bill enters into force, the reduction factor is promised to be either frozen or slightly increased. However, it is also likely that when discussing the prospect of a reduction factor, it will be decided to abandon it altogether. However, it does not make sense to talk about this innovation until 2023.

What will happen to military pensions in 2019?

In 2019, it is planned that the reform will start working, which will also affect innovations in matters of pensions for military personnel. It is planned that the changes will be quite controversial, but necessary.

Length of service will increase from 20 to 25 years. This innovation has already been approved at the official level. Such a reform would avoid inequality in the country and equalize civil pensioners with military personnel.

It is possible that the moratorium established in 2018 on changing the reduction factor will be lifted.

You can also expect indexing. According to official statements from the Department of Defense, retirees can count on a two-stage increase in social benefits.

  1. The first stage will start on October 1, 2019.
  2. The second stage is exactly one year later, in 2020.

But the value of the reduction coefficient should remain at the same level, and also correspond to the current salaries of military personnel.

In order to carry out the reform, 41 billion rubles have already been frozen in the state budget. With these funds, the Government plans to support military pensioners, as well as jinx the transition process in the face of inflation.

That draft law envisaged such a mechanism - the introduction of a transition period until 2019, when the military would have a choice whether to retire after 20 years of service or continue to serve and at the same time receive 25% of their own potential pension in addition to their salary. From 2019, the length of service in accordance with the project was to increase to 25 years, and the transition period would come to an end.

The military pension reform project of 2013, after the calculations, was recognized as unsuccessful - the implementation required funds that were not available even in fairly well-fed times.

In 2015, a very radical proposal from the Ministry of Finance appeared. This department proposed to raise the minimum length of service for military personnel immediately to 30 years. The idea, of course, was also considered unsuccessful.

The history of the emergence of such bills indicates that they appear every 2 years, after which they are forgotten. The proposals of 2013 and 2015 were considered unsuccessful. So far, the news about the project that arose in 2017 has not received development.

However, the bill of 2017 is fundamentally different from the previous ones in that it was initiated after the direct order of Vladimir Putin.

At the same time, in the summer of 2017, Kommersant sources said that although the project was ready in general terms, its adoption would be almost 100% delayed. The reason is the March presidential elections in the country, because of which any unpopular measures were moved to a later date.

The elections are over, and the first unpopular decision, which is no longer embarrassed, is already being prepared for adoption. This refers to raising the retirement age for ordinary citizens of the country. A direct decision has not yet been made, but the government has ceased to hide that it is only a matter of time.

The military can expect the same. Having completed the reform of raising the retirement age for ordinary pension recipients, the authorities can then return to the idea of ​​raising the length of service to 25 years for military personnel and other employees of law enforcement agencies.
