2. Recognize as invalid:

I. General provisions

1. Intersectoral rules for providing workers with special clothing, special footwear and other personal protective equipment (hereinafter referred to as the Rules) establish mandatory requirements for the acquisition, issuance, use, storage and care of special clothing, special footwear and other personal protective equipment (hereinafter referred to as PPE) .

2. The requirements of these Rules apply to employers - legal entities and individuals, regardless of their organizational and legal forms and forms of ownership.

3. For the purposes of this order, PPE means personal use means used to prevent or reduce the impact of harmful and (or) hazardous production factors on workers, as well as to protect against pollution.

4. The employer is obliged to ensure the acquisition and issuance of PPE certified in accordance with the established procedure or declaration of conformity to employees employed in work with harmful and (or) dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution.

The purchase of PPE is carried out at the expense of the employer.

It is allowed for the employer to purchase PPE for temporary use under a lease agreement.

Employees engaged in work with harmful and (or) dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution, are given the appropriate PPE free of charge.

5. The provision of PPE to employees, including those purchased by the employer for temporary use under a lease agreement, is carried out in accordance with the standard norms for the free issuance of special clothing, special footwear and other personal protective equipment (hereinafter referred to as the standard norms), which have been duly certified or declared compliance, and based on the results of a special assessment of working conditions.

6. The employer has the right, taking into account the opinion of the elected body of the primary trade union organization or other representative body of employees and its financial and economic situation, to establish norms for the free issue of special clothing, special footwear and other personal protective equipment to employees, which improve, compared with standard norms, the protection of workers from existing at workplaces of harmful and (or) dangerous factors, as well as special temperature conditions or pollution.

These standards are approved by the employer's local regulations based on the results of a special assessment of working conditions and taking into account the opinion of the relevant trade union or other body authorized by employees and can be included in a collective and (or) labor agreement indicating model standards, in comparison with which the provision of employees improves personal protective equipment.

7. The employer has the right, taking into account the opinion of the elected body of the primary trade union organization or other representative body authorized by the employees, to replace one type of personal protective equipment provided for by the standard norms with a similar one that provides equivalent protection against hazardous and harmful production factors.

8. The issuance of PPE to employees, including foreign-made, as well as special clothing that is temporarily used by the employer under a lease agreement, is allowed only if there is a certificate or declaration of conformity confirming the compliance of the PPE issued with the safety requirements established by law, as well as the availability sanitary and epidemiological conclusion or certificate of state registration of dermatological PPE, issued in the prescribed manner (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

Dermatological means of personal skin protection against harmful factors for use in production are subject to state registration by Rospotrebnadzor in accordance with the Decrees of the Government of the Russian Federation of December 21, 2000 N 988 "On State Registration of New Food Products, Materials and Products" (Collected Legislation of the Russian Federation, 2001 , N 1 (part II), art. 124; 2007, N 10, art. 1244) and dated April 4, 2001 N 262 "On state registration of certain types of products that pose a potential danger to humans, as well as certain types of products, imported for the first time into the territory of the Russian Federation" (Sobraniye zakonodatelstva Rossiyskoy Federatsii, 2001, N 17, art. 1711).

Acquisition (including under a lease agreement) of PPE that does not have a declaration of conformity and (or) a certificate of conformity or has a declaration of conformity and (or) a certificate of conformity that has expired is not allowed.

9. The employer is obliged to ensure that employees are informed about the PPE they are entitled to. During the introductory briefing, the employee must be familiar with these Rules, as well as with the standard norms for issuing PPE corresponding to his profession and position.

10. The employee is obliged to correctly apply the PPE issued to him in the prescribed manner.

11. In case of failure to provide an employee engaged in work with harmful and (or) dangerous working conditions, as well as with special temperature conditions or associated with pollution, PPE, in accordance with the legislation of the Russian Federation, he has the right to refuse to perform labor duties, and the employer does not have the right to demand from the employee their performance and is obliged to pay the downtime that has arisen for this reason (paragraph as amended by the order of the Ministry of Health and Social Development of Russia of January 27, 2010 N 28n.

II. The procedure for issuing and applying PPE

12. PPE issued to workers should be appropriate for their gender, height, size, and the nature and conditions of the work they perform.

13. The employer is obliged to organize proper accounting and control over the issuance of PPE to employees in a timely manner.

The terms of use of PPE are calculated from the date of their actual issuance to employees.

The issuance of PPE to employees and the delivery of PPE by them are recorded in the personal PPE issuance card, the form of which is given in the appendix to these Rules (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

The employer has the right to keep records of the issuance of PPE to employees using software tools (information and analytical databases). The electronic form of the registration card must correspond to the established form of the personal registration card for the issuance of PPE. At the same time, in the electronic form of a personal record card for the issuance of PPE, instead of the employee’s personal signature, the number and date of the accounting document on the receipt of PPE, which has the employee’s personal signature, are indicated (the paragraph was supplemented by order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

It is allowed to keep records of the issuance of PPE in electronic form with the mandatory personalization of the employee.

The employer has the right to organize the issuance of PPE and their replaceable elements of a simple design that do not require additional instruction through automated issuance systems (vending equipment). This requires the personification of the employee and the automatic filling in of data on the issued PPE in the electronic form of the PPE issuance card.

14. When issuing PPE to employees, the employer is guided by standard norms corresponding to his type of activity.

In the absence of professions and positions in the relevant model norms, the employer issues PPE to employees, provided for by the model norms for workers in cross-cutting professions and positions in all sectors of the economy, and in the absence of professions and positions in these model norms, by model norms for workers whose professions (positions) are characteristic of work performed.

15. Brigadiers, foremen performing the duties of foremen, assistants and assistants to workers whose professions are specified in the relevant model standards are issued the same personal protective equipment as employees of the relevant professions.

16. The PPE of workers, specialists and other employees provided for in the standard norms of PPE is issued to the specified workers even if they are senior in their profession and position and perform directly those works that give the right to receive these personal protective equipment (paragraph as amended by the order Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

17. Employees who combine professions or constantly perform combined work, including as part of integrated teams, in addition to the PPE issued to them in the main profession, are additionally issued, depending on the work performed, and other types of PPE provided for by the relevant model standards for the combined profession (combined type works) with a note on the issued PPE in the personal record card for the issuance of PPE.

18. Employees temporarily transferred to another job, employees and other persons undergoing vocational training (retraining) in accordance with the apprenticeship contract, students and students of educational institutions of primary, secondary and higher vocational education for the period of industrial practice (industrial training), foremen industrial training, as well as to other persons participating in the production activities of the employer or carrying out, in accordance with the current legislation, measures for control (supervision) in the established field of activity, PPE is issued in accordance with the standard norms and Rules for the duration of this work (passing vocational training, retraining, industrial practice, industrial training) or implementation of control (supervision) measures.

Employees of third-party organizations, when performing work in production shops and areas where there are harmful and (or) dangerous production factors that may affect employees, must be provided by their employer with PPE in accordance with the standard standards provided for employees of relevant professions and positions of the organization, to which they are sent.

Managers and specialists who, in accordance with their official duties, periodically visit production premises (sites) and may therefore be exposed to harmful and (or) hazardous production factors, should be issued with appropriate PPE as on-duty (for the duration of the visit to these facilities).

19. In cases where such PPE as a signal vest, safety harness, restraint harness (safety belt), dielectric galoshes and gloves, a dielectric mat, goggles and shields that filter respiratory PPE with antiaerosol and gas filters, insulating PPE of organs breathing, protective helmet, balaclava, mosquito net, helmet, shoulder pads, elbow pads, self-rescuers, earmuffs, earmuffs, light filters, anti-vibration gloves or gloves, etc. not specified in the relevant standard norms, they can be issued to employees with a wear period "to wear out" based on the results of a special assessment of working conditions, as well as taking into account the conditions and characteristics of the work performed.

The PPE mentioned above is also issued based on the results of a special assessment of working conditions for periodic use in the performance of certain types of work (hereinafter referred to as on-duty PPE). At the same time, anti-noise liners, balaclavas, as well as PPE of the respiratory organs, which do not allow multiple use and are issued as "on duty", are issued in the form of a one-time set before the work shift in an amount corresponding to the number of employees at this workplace

20. On-duty PPE for general use is issued to employees only for the duration of the work for which they are intended (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

The specified PPE, taking into account the requirements of personal hygiene and the individual characteristics of workers, are assigned to certain jobs and transferred from one shift to another (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

In such cases, PPE is issued under the responsibility of the heads of structural units authorized by the employer to carry out these works.

21. PPE intended for use in special temperature conditions due to annual seasonal temperature changes are issued to employees with the onset of the corresponding period of the year, and at the end of it are handed over to the employer for organized storage until the next season (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

The time for using these types of PPE is set by the employer, taking into account the opinion of the elected body of the primary trade union organization or other representative body of workers and local climatic conditions.

The period for wearing PPE used in special temperature conditions includes the time of their organized storage.

22. PPE returned by employees after the expiration of the socks, but suitable for further use, are used for their intended purpose after taking care of them (washing, cleaning, disinfection, degassing, decontamination, dust removal, decontamination and repair). The suitability of the specified PPE for further use, the need for and composition of measures to care for them, as well as the percentage of wear and tear of PPE are established by an authorized employer by an official or by the organization’s labor protection commission (if any) and are recorded in the personal PPE issuance record card (paragraph as amended by the order Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

23. PPE, rented, is issued in accordance with the standard rules. When an employee is issued with special clothing rented by the employer, an individual set of PPE is assigned to the employee, for which the appropriate marking is applied to it. Information about the issuance of this kit is entered in the personal card of accounting and issuance of PPE of the employee.

24. When issuing PPE, the use of which requires practical skills from employees (respirators, gas masks, self-rescuers, safety belts, mosquito nets, helmets, etc.), the employer ensures that employees are instructed on the rules for using these PPE, the simplest ways to check their performance and serviceability, and also organizes training on their application (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

25. In case of loss or damage to PPE in the designated places of their storage for reasons beyond the control of employees, the employer issues them other serviceable PPE. The employer provides for the replacement or repair of PPE that has become unusable before the end of the wearing period for reasons beyond the control of the employee

26. The employer ensures the mandatory use of PPE by employees (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

Employees are not allowed to perform work without PPE issued to them in accordance with the established procedure, as well as with faulty, unrepaired and contaminated PPE.

27. At the end of the working day, employees are prohibited from taking PPE outside the territory of the employer or the territory where work is performed by the employer - an individual entrepreneur. IN individual cases when, according to the working conditions, it is impossible to comply with the specified procedure (for example, at logging, at geological work, etc.), PPE remains with the workers after hours (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

28. Employees must notify the employer (or his representative) of the failure (malfunction) of PPE.

29. In accordance with the deadlines established in national standards, the employer ensures the testing and serviceability of PPE, as well as the timely replacement of parts of PPE with reduced protective properties. After checking the serviceability of the PPE, a mark (stamp, stamp) is put on the timing of the next test (paragraph as amended by the order of the Ministry of Health and Social Development of Russia dated January 27, 2010 N 28n.

III. The procedure for organizing the storage of PPE and care for them

30. The employer, at his own expense, is obliged to ensure the care and storage of PPE, timely dry-clean, wash, degas, decontaminate, disinfect, decontaminate, dedust, dry PPE, as well as repair and replace PPE.

For these purposes, the employer has the right to issue to employees 2 sets of appropriate PPE with a double wear period.

31. For the storage of PPE issued to employees, the employer provides, in accordance with the requirements of building codes and regulations, specially equipped rooms (dressing rooms).

32. If the employer does not have the technical capabilities for dry cleaning, washing, repair, decontamination, decontamination, neutralization and dedusting of PPE, these works are carried out by an organization engaged by the employer under a civil law contract.

33. Depending on the working conditions, the employer (in its structural divisions) arranges dryers, chambers and installations for drying, dedusting, degassing, decontamination and disposal of PPE (paragraph as amended by the order of the Ministry of Health and Social Development of Russia of January 27, 2010 N 28n.

IV. Final provisions

34. Responsibility for the timely and full issuance to employees of PPE that has been duly certified or declaration of conformity to PPE in accordance with standard norms, for organizing control over the correct use of them by employees, as well as for storing and caring for PPE rests with the employer (his representative) .

35. State supervision and control over compliance by the employer with these Rules is carried out by the federal executive body, which exercises the functions of supervision and control over compliance with labor legislation and other regulatory legal acts containing labor law norms, and its territorial bodies (state labor inspectorates in the constituent entities of the Russian Federation) .

36. Control over compliance by employers (legal entities and individuals) with these Rules in subordinate organizations is carried out in accordance with Articles 353 and 370 of the Labor Code of the Russian Federation by federal executive authorities, executive authorities of the constituent entities of the Russian Federation and local governments, as well as trade unions, their associations and the technical labor inspectors and authorized (trusted) persons for labor protection that are under their jurisdiction.

4. 6. The employer has the right, taking into account the opinion of the elected body of the primary trade union organization or other representative body of employees and its financial and economic situation, to establish norms for the free issue of special clothing, special footwear and other personal protective equipment to employees, which improve, compared with standard norms, the protection of workers from existing at workplaces of harmful and (or) dangerous factors, as well as special temperature conditions or pollution.

These standards are approved by the employer's local regulations based on the results of a special assessment of working conditions and taking into account the opinion of the relevant trade union or other body authorized by employees and can be included in a collective and (or) labor agreement indicating model standards, in comparison with which the provision of employees improves personal protective equipment. 7. The employer has the right, taking into account the opinion of the elected body of the primary trade union organization or other representative body authorized by the employees, to replace one type of personal protective equipment provided for by the standard norms with a similar one that provides equivalent protection against hazardous and harmful production factors.

8. The issuance of PPE to employees, including foreign-made, as well as special clothing that is temporarily used by the employer under a lease agreement, is allowed only if there is a certificate or declaration of conformity confirming the compliance of the PPE issued with the safety requirements established by law, as well as the availability sanitary and epidemiological conclusion or certificate of state registration of dermatological PPE<*>drawn up in the prescribed manner. <*>Dermatological means of personal skin protection against harmful factors for use in production are subject to state registration by Rospotrebnadzor in accordance with Decrees of the Government of the Russian Federation of December 21, 2000 N 988 "On State Registration of New Food Products, Materials and Products" (Collected Legislation of the Russian Federation, 2001, N 1 (part II), art. 124; 2007, N 10, art. 1244) and dated April 4, 2001 N 262 "On state registration of certain types of products that pose a potential danger to humans, as well as certain types products imported into the territory of the Russian Federation for the first time" (Sobraniye zakonodatelstva Rossiyskoy Federatsii, 2001, No. 17, item 1711).

Decree of the Government of the Russian Federation of December 21, 2000 N 988 and Decree of the Government of the Russian Federation of April 4, 2001 N 262 have become invalid. Similar norms are contained in Section 2 of the Unified list of goods subject to sanitary and epidemiological supervision (control) at the customs border and customs territory of the customs union (approved by the Decision of the Commission of the EurAsEC Customs Union dated May 28, 2010 N 299)

Acquisition (including under a lease agreement) of PPE that does not have a declaration of conformity and (or) a certificate of conformity or has a declaration of conformity and (or) a certificate of conformity that has expired is not allowed. 9. The employer is obliged to ensure that employees are informed about the PPE they are entitled to. During the introductory briefing, the employee must be familiar with these Rules, as well as with the standard norms for issuing PPE corresponding to his profession and position. 10. The employee is obliged to correctly apply the PPE issued to him in the prescribed manner.

11. In case of failure to provide an employee engaged in work with harmful and (or) dangerous working conditions, as well as with special temperature conditions or associated with pollution, PPE, in accordance with the legislation of the Russian Federation, he has the right to refuse to perform labor duties, and the employer does not have the right to demand from the employee their performance and is obliged to pay the downtime that has arisen for this reason. II. The procedure for issuing and applying PPE

12. PPE issued to workers should be appropriate for their gender, height, size, and the nature and conditions of the work they perform.

13. The employer is obliged to organize proper accounting and control over the issuance of PPE to employees in a timely manner.

The terms of use of PPE are calculated from the date of their actual issuance to employees.

The issuance of PPE to employees and the delivery of PPE by them are recorded in a personal record card for the issuance of PPE, the form of which is given in the appendix to these Rules. The employer has the right to keep records of the issuance of PPE to employees using software tools (information and analytical databases). The electronic form of the registration card must correspond to the established form of the personal registration card for the issuance of PPE. At the same time, in the electronic form of a personal record card for the issuance of PPE, instead of the personal signature of the employee, the number and date of the accounting document on receipt of PPE, which has the personal signature of the employee, are indicated. It is allowed to keep records of the issuance of PPE in electronic form with the mandatory personalization of the employee. (as amended by the Order of the Ministry of Labor of the Russian Federation of 12.01.2015 N 2n)

The employer has the right to organize the issuance of PPE and their replaceable elements of a simple design that do not require additional instruction through automated issuance systems (vending equipment). This requires the personification of the employee and the automatic filling in of data on the issued PPE in the electronic form of the PPE issuance card. 14. When issuing PPE to employees, the employer is guided by standard norms corresponding to his type of activity. (as amended by the Order of the Ministry of Labor of the Russian Federation of 12.01.2015 N 2n)

In the absence of professions and positions in the relevant model norms, the employer issues PPE to employees, provided for by the model norms for workers in cross-cutting professions and positions in all sectors of the economy, and in the absence of professions and positions in these model norms, by model norms for workers whose professions (positions) are characteristic of work performed. 15. Brigadiers, foremen performing the duties of foremen, assistants and assistant workers, whose professions are specified in the relevant standard norms, are issued the same PPE as employees of the relevant professions.

16. The PPE of workers, specialists and other employees provided for in the standard norms of personal protective equipment is issued to the specified workers even if they are senior in their profession and position and perform directly the work that gives the right to receive these personal protective equipment. 17. Employees who combine professions or constantly perform combined work, including as part of complex teams, in addition to the PPE issued to them in the main profession, are additionally issued, depending on the work performed, and other types of PPE provided for by the relevant model standards for the combined profession (combined type of work ) with a note on the issued PPE in the personal record card for the issuance of PPE. 18. Employees temporarily transferred to another job, employees and other persons undergoing vocational training (retraining) in accordance with the apprenticeship contract, students and students of educational institutions of primary, secondary and higher vocational education for the period of industrial practice (industrial training), foremen industrial training, as well as to other persons participating in the production activities of the employer or carrying out, in accordance with the current legislation, measures for control (supervision) in the established field of activity, PPE is issued in accordance with the standard norms and Rules for the duration of this work (passing vocational training, retraining, industrial practice, industrial training) or implementation of control (supervision) measures. Employees of third-party organizations, when performing work in production shops and areas where there are harmful and (or) dangerous production factors that may affect employees, must be provided by their employer with PPE in accordance with the standard standards provided for employees of relevant professions and positions of the organization, to which they are sent. (as amended by the Order of the Ministry of Labor of the Russian Federation of 12.01.2015 N 2n)

Managers and specialists who, in accordance with their official duties, periodically visit production premises (sites) and may therefore be exposed to harmful and (or) hazardous production factors, should be issued with appropriate PPE as on-duty (for the duration of the visit to these facilities). (as amended by the Order of the Ministry of Labor of the Russian Federation of 12.01.2015 N 2n)

19. In cases where such PPE as a signal vest, safety harness, restraint harness (safety belt), dielectric galoshes and gloves, a dielectric mat, goggles and shields that filter respiratory PPE with antiaerosol and gas filters, insulating PPE of organs breathing, protective helmet, balaclava, mosquito net, helmet, shoulder pads, elbow pads, self-rescuers, earmuffs, earmuffs, light filters, anti-vibration gloves or gloves, etc. not specified in the relevant standard norms, they can be issued to employees with a wear period "to wear out" based on the results of a special assessment of working conditions, as well as taking into account the conditions and characteristics of the work performed. The PPE mentioned above is also issued based on the results of a special assessment of working conditions for periodic use in the performance of certain types of work (hereinafter referred to as on-duty PPE). At the same time, anti-noise liners, balaclavas, as well as PPE of the respiratory organs, which do not allow multiple use and are issued as "on duty", are issued in the form of a one-time set before a work shift in an amount corresponding to the number of employees at a given workplace. 20. On-duty PPE for general use is issued to employees only for the duration of the work for which they are intended. (As amended by the Order of the Ministry of Health and Social Development of the Russian Federation dated January 27, 2010 N 28n)

The specified PPE, taking into account the requirements of personal hygiene and the individual characteristics of workers, are assigned to certain jobs and transferred from one shift to another. In such cases, PPE is issued under the responsibility of the heads of structural units authorized by the employer to carry out these works.

21. PPE intended for use in special temperature conditions due to annual seasonal temperature changes are issued to employees with the onset of the corresponding period of the year, and at the end of it are handed over to the employer for organized storage until the next season. The time for using these types of PPE is set by the employer, taking into account the opinion of the elected body of the primary trade union organization or other representative body of workers and local climatic conditions.

The period for wearing PPE used in special temperature conditions includes the time of their organized storage.

22. PPE returned by employees after the expiration of the socks, but suitable for further use, are used for their intended purpose after taking care of them (washing, cleaning, disinfection, degassing, decontamination, dust removal, decontamination and repair). The suitability of the specified PPE for further use, the need for and composition of measures to care for them, as well as the percentage of wear and tear of PPE are established by an authorized employer official or the organization’s labor protection commission (if any) and are recorded in the personal PPE issuance record card. 23. PPE, rented, is issued in accordance with the standard rules. When an employee is issued with special clothing rented by the employer, an individual set of PPE is assigned to the employee, for which the appropriate marking is applied to it. Information about the issuance of this kit is entered in the personal card of accounting and issuance of PPE of the employee.

24. When issuing PPE, the use of which requires practical skills from employees (respirators, gas masks, self-rescuers, safety belts, mosquito nets, helmets, etc.), the employer ensures that employees are instructed on the rules for using these PPE, the simplest ways to check their performance and serviceability, and organizes training on their application. 25. In the event of loss or damage to PPE in the designated places of their storage for reasons beyond the control of employees, the employer issues them other serviceable PPE. The employer provides for the replacement or repair of PPE that has become unusable before the end of the wearing period for reasons beyond the control of the employee. 26. The employer ensures the mandatory use of PPE by employees. (As amended by the Order of the Ministry of Health and Social Development of the Russian Federation dated January 27, 2010 N 28n)

Employees are not allowed to perform work without PPE issued to them in accordance with the established procedure, as well as with faulty, unrepaired and contaminated PPE.

27. At the end of the working day, employees are prohibited from taking PPE outside the territory of the employer or the territory where work is performed by the employer - an individual entrepreneur. In some cases, when the specified procedure cannot be observed due to working conditions (for example, at logging, geological work, etc.), PPE remains with employees during non-working hours. 28. Employees must notify the employer (or his representative) of the failure (malfunction) of PPE.

29. In accordance with the deadlines established in national standards, the employer ensures the testing and serviceability of PPE, as well as the timely replacement of parts of PPE with reduced protective properties. After checking the serviceability of the PPE, a mark (stamp, stamp) is put on the timing of the next test. III. The procedure for organizing the storage of PPE and care for them

30. The employer, at his own expense, is obliged to ensure the care and storage of PPE, timely dry-clean, wash, degas, decontaminate, disinfect, decontaminate, dedust, dry PPE, as well as repair and replace PPE. For these purposes, the employer has the right to issue to employees 2 sets of appropriate PPE with a double wear period. (As amended by the Order of the Ministry of Health and Social Development of the Russian Federation dated January 27, 2010 N 28n)

31. For the storage of PPE issued to employees, the employer provides, in accordance with the requirements of building codes and regulations, specially equipped rooms (dressing rooms).

32. If the employer does not have the technical capabilities for dry cleaning, washing, repair, decontamination, decontamination, neutralization and dedusting of PPE, these works are carried out by an organization engaged by the employer under a civil law contract.

33. Depending on the working conditions, the employer (in its structural divisions) arranges dryers, chambers and installations for drying, dust removal, degassing, decontamination and disposal of PPE. IV. Final provisions

34. Responsibility for the timely and full issuance to employees of PPE that has been duly certified or declared conformity in accordance with standard norms, for organizing control over the correct use of them by employees, as well as for storing and caring for PPE rests with the employer (his representative) .

35. State supervision and control over compliance by the employer with these Rules is carried out by the federal executive body, which exercises the functions of supervision and control over compliance with labor legislation and other regulatory legal acts containing labor law norms, and its territorial bodies (state labor inspectorates in the constituent entities of the Russian Federation) .

36. Control over compliance by employers (legal entities and individuals) with these Rules in subordinate organizations is carried out in accordance with articles and the Labor Code of the Russian Federation<*>federal executive authorities, executive authorities of the constituent entities of the Russian Federation and local governments, as well as trade unions, their associations and technical labor inspectors and authorized (trusted) persons for labor protection.

PROVISION OF WORKERS WITH SPECIAL CLOTHING, SPECIAL
FOOTWEAR AND OTHER PERSONAL PROTECTION EQUIPMENT

I. General provisions

1. Intersectoral rules for providing workers with special clothing, special footwear and other personal protective equipment (hereinafter referred to as the Rules) establish mandatory requirements for the acquisition, issuance, use, storage and care of special clothing, special footwear and other personal protective equipment (hereinafter referred to as PPE) .

2. The requirements of these Rules apply to employers - legal entities and individuals, regardless of their organizational and legal forms and forms of ownership.

3. For the purposes of this Order, PPE means personal use means used to prevent or reduce exposure of workers to harmful and (or) hazardous production factors, as well as to protect against pollution.

4. The employer is obliged to ensure the acquisition and issuance of PPE certified in accordance with the established procedure or declaration of conformity to employees employed in work with harmful and (or) dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution.

The purchase of PPE is carried out at the expense of the employer.

It is allowed for the employer to purchase PPE for temporary use under a lease agreement.

Employees engaged in work with harmful and (or) dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution, are given the appropriate PPE free of charge.

5. The provision of PPE to employees, including those purchased by the employer for temporary use under a lease agreement, is carried out in accordance with the standard norms for the free issuance of special clothing, special footwear and other personal protective equipment (hereinafter referred to as the standard norms), which have been certified or declared in the prescribed manner compliance, and based on the results of a special assessment of working conditions.

6. The employer has the right, taking into account the opinion of the elected body of the primary trade union organization or other representative body of employees and its financial and economic situation, to establish norms for the free issue of special clothing, special footwear and other personal protective equipment to employees, which improve, compared with standard norms, the protection of workers from existing at workplaces of harmful and (or) dangerous factors, as well as special temperature conditions or pollution.

    At work with harmful and (or) dangerous working conditions, as well as at work performed in especially temperature conditions or associated with pollution, employees are issued certified personal protective equipment that flushes and neutralizes agents in accordance with the standards approved in the manner established by the Government of the Russian Federation.     The acquisition, storage, washing, cleaning, repair, disinfection and disposal of personal protective equipment for employees is carried out at the expense of the employer.

    Workers' personal protective equipment (PPE) must meet the following general requirements:

    - prevent or reduce the impact of harmful and dangerous production factors;

    - means of protection should not be a source of harmful or dangerous production factors;

    - means of protection are evaluated by protective indicators;

    – PPE is used only in the absence of effective collective protection.

    Free overalls, safety shoes and protective gear are issued to workers and employees to protect:

    a) from pollution at work that causes increased dust emission, with substances that color and corrode the skin: lime, cement, paints, acids, alkalis, leaded gasoline, etc .;

    b) from splashes of molten metal during electric and gas welding;

    c) from burns and other thermal effects when working at elevated temperatures;

    d) from hypothermia of the body when working at low temperatures;

    e) from bodily injury while working on machines and mechanisms;

    f) from dampness and moisture when working in water and at high humidity;

    g) from electric shock;

    h) against falling when working at height;

    i) from harmful effects on the eyes of light (during electric welding) and other radiation, etc.;

    j) from the harmful effects of gases and vapors on skin and internal organs of the worker.

    The following personal protective equipment may be used at the enterprise:

    Special clothing:

    – overalls, semi-overalls;

    - jackets, trousers, suits, dressing gowns, raincoats, sheepskin coats, sheepskin coats;

    - aprons, vests, sleeves.

    Special footwear.

    Hand protection:

    - mittens, gloves.

    Head protection:

    - helmets, helmets, balaclavas, hats.

    Face protection:

    - protective masks, protective shields.

    Respiratory protection equipment:

    - gas masks, respirators.

    The employer is obliged to ensure the storage, washing, drying, disinfection, decontamination, decontamination and repair of special clothing, special footwear and other personal protective equipment issued to employees in accordance with established standards.

    When organizing work to provide employees of the enterprise with personal protective equipment, it is necessary to be guided by the following documents:

    Providing employees with special clothing, footwear and other personal protective equipment is not as rare as it might seem at first glance. For example, under the law, the employer is required to provide PPE for employees whose work is associated with pollution. And this category includes, among other things, cleaners and drivers - positions that are available in almost every organization. In addition, PPE must be mandatory issued to employees employed in work with harmful and dangerous working conditions, such as welders, laboratory assistants, locksmiths, etc. With the introduction of a special assessment of working conditions that is mandatory for all employers, it is unlikely that it will be possible to “forget” to provide their employees with overalls and PPE - a reminder will be the report of a specialized organization based on the results of a special assessment. Therefore, employers need to be prepared to finance the purchase of PPE, and accountants need to reflect them in the accounting.

    The procedure for providing workers with overalls and other PPE

    The employer is responsible for ensuring safe working conditions and labor protection. To this end, the Labor Code of the Russian Federation provides for the issuance of personal protective equipment (PPE) to workers employed in work with harmful and (or) dangerous working conditions, as well as in work performed in special temperature conditions or associated with pollution (Article 212 of the Labor Code of the Russian Federation). Wherein personal protective equipment includes special clothing, special footwear and safety devices (overalls, suits, jackets, trousers, dressing gowns, sheepskin coats, sheepskin coats, various footwear, mittens, goggles, helmets, gas masks, respirators) used to prevent or reduce exposure of workers to harmful and (or) hazardous production factors, as well as for protection against pollution.

    The procedure for providing employees with PPE established by the Intersectoral Rules for Providing Workers with Special Clothing, Special Footwear and Other Personal Protective Equipment (approved by Order of the Ministry of Health and Social Development of Russia No. 290n dated June 1, 2009), in accordance with which:

    • The purchase of PPE is made by the employer using own funds, it is also allowed to purchase PPE for temporary use under a lease agreement.
    • PPE intended to be issued to employees must have valid certificate or declaration of conformity, confirming compliance with the safety requirements established by law.
    • Overalls and other PPE are issued to employees, free based on results and issuance standards.

    Model norms for issuing PPE to employees, universal for all sectors of the economy, are established by the following documents:

    • Order of the Ministry of Health and Social Development of the Russian Federation of 01.10.2008 N 541n (valid until 27.05.2015), Order of the Ministry of Labor of Russia of 09.12.2014 N 997n (valid from 28.05.2015) - in relation to special clothing and footwear and other PPE by profession and positions;
    • Decree of the Ministry of Labor of Russia of December 31, 1997 N 70 - in relation to warm special clothing and footwear for climatic zones;
    • Order of the Ministry of Health and Social Development of Russia dated April 20, 2006 N 297 - in relation to special high-visibility signal clothing.

    In addition to industry-wide, there are standard standards for the issuance of PPE, applied in each specific industry, for example, in construction, transport, healthcare. In addition, if there are financial possibilities, the employer has the right to establish higher norms for issuing or otherwise improve the provision of employees with protective equipment. The established procedure for issuing PPE must be fixed in the relevant local regulatory act.

    In order to comply with the norms for issuing PPE to employees and the timing of their use, the employer must organize accounting for PPE in use. The issuance and return of overalls is reflected in the personal record card for the issuance of personal protective equipment, the form of which is established by the Intersectoral Rules (Order of the Ministry of Health and Social Development of Russia dated 01.06.2009 No. 290n).

    Personal cards for the issuance of PPE can be filled out both in paper and electronic form. In the latter case, instead of the personal signature of the employee, the date and number of the accounting document is affixed, which contains the employee's signature in receiving PPE (for example, a demand-invoice).

    ! Note: Overalls and other PPE are issued to employees for use while ownership remains with the employer. Therefore, upon dismissal or transfer to another job, the employee is obliged to return the received PPE, otherwise the cost of PPE may be deducted from wages.

    Tax accounting of overalls and PPE

    Taxpayers have the right to take into account as expenses the costs of purchasing overalls and other PPE for employees both for calculating income tax and under the simplified tax system. However, it is possible to take into account the costs of PPE only within the current standard issuance rates or higher rates confirmed by(Letters of the Ministry of Finance dated November 25, 2014 No. 03-03-06/1/59763, dated February 16, 2012 No. 03-03-06/4/8).

    The procedure for accepting for tax accounting the costs of purchasing PPE depends on their cost and period of use. Depending on these factors, PPE can be accounted for either as material costs or as part of the cost of acquiring fixed assets.

    If PPE is accepted for tax accounting as fixed assets, then their cost is written off as expenses after commissioning (issuance to an employee):

    • with OSN - monthly during the established period of use by accruing depreciation;
    • with the simplified tax system - at a time on the last day of the reporting (tax) period in the amount of the amounts paid (clause 3 of article 346.16, clause 4 of clause 2 of article 346.17 of the Tax Code of the Russian Federation)

    If PPE is included in the composition material costs, then their value is accepted for tax accounting:

    • For DOS - at a time when commissioning (issuing to an employee) or evenly, taking into account the period of use or other economically justified indicators (if the period of use of PPE exceeds one reporting period for income tax) (clause 3, clause 1, article 254 of the Tax Code of the Russian Federation) . The PPE accounting option chosen by the taxpayer must be fixed in the accounting policy for tax purposes;
    • With the simplified tax system - at a time after posting and payment.

    ! Note: If the cost of purchased PPE is partially or fully reimbursed at the expense of the FSS, then the reimbursement amounts should be accounted for for tax purposes as non-operating income. The procedure for reimbursement of expenses for the purchase of special clothing and other PPE for employees is generally similar to the procedure for reimbursement, which is described in one of the previous articles.

    personal income tax and insurance premiums

    Since special clothing and other PPE are issued to employees for use, without transfer of ownership, and are not remuneration for work, their cost does not apply to employees' income. In this regard, the cost of PPE transferred to employees is not a subject to a tax:

    • personal income tax (Article 207 of the Tax Code of the Russian Federation);
    • insurance premiums to the PFR, FFOMS and FSS (Article 7 federal law dated July 24, 2009 N 212-FZ, paragraph 1 of Art. 20.1 of the Federal Law of July 24, 1998 N 125-FZ).

    Accounting for overalls and PPE

    For the purpose of accounting for special clothing and other PPE, organizations should be guided by the Methodological Guidelines for Accounting for Special Tools, Special Devices, Special Equipment and Special Clothing (approved by Order of the Ministry of Finance of Russia dated December 26, 2002 N 135n). In accordance with these instructions, PPE, regardless of their cost and period of use, are accounted for as inventories (on account 10). However, the organization has the right to provide for the accounting of PPE that meets the criteria for fixed assets as part of fixed assets (account 01) (Letter of the Ministry of Finance of the Russian Federation of May 12, 2003 No. 16-00-14 / 159).

    ! Note: Since accounting for PPE as fixed assets is the right of the organization, the choice of a specific accounting option must be fixed in the accounting policy for accounting purposes:

    • Option 1. Special clothing and other personal protective equipment are accounted for as part of inventories, regardless of cost and service life.
    • Option 2. Special clothing and other personal protective equipment worth more than 40,000 rubles * and with a service life of more than a year are accounted for as fixed assets in the manner established by PBU 6/01. Special clothing and other personal protective equipment that do not meet the specified criteria are included in the MPZ.

    * The organization has the right to establish another cost criterion for classifying inventory as fixed assets, but not more than 40,000 rubles. (paragraph 4, clause 5 PBU 6/01)

    Since the second option of accounting for PPE corresponds to the reflection of PPE in tax accounting, it is advisable to choose and register it in the accounting policy: this will make it possible to bring tax and accounting as close as possible.

    The procedure for writing off the cost of purchased PPE to expenses depends on how they are accounted for.

    • If PPE is accepted for accounting as part of the MPZ, then their cost in accordance with the Guidelines should be written off as expenses linearly over the entire period of use (clause 26 of the Guidelines).

    ! Note: The cost of PPE, the service life of which does not exceed 12 months, can be deducted as a lump sum at the time of transfer to the employee (clause 21 of the Methodological Instructions). However, such an accounting option must be fixed in the accounting policy for accounting purposes, and it is better if it coincides with the option chosen for tax accounting purposes.

    • If PPE are accepted for accounting as fixed assets (that is, they meet the criteria for recognizing assets as fixed assets), then their cost is written off to expenses by accruing depreciation.
